Former President Trump's Team Seeks Supreme Court Approval to Fire Top Intellectual Property Director

The ex- president's administration on Monday petitioned the nation's highest court to allow the termination of the director of the American copyright authority.

This emergency request comes roughly a month and a half after a national appellate court in Washington decided that the director, Shira Perlmutter, cannot be solely dismissed.

Nearly one month ago, the full District of Columbia appeals court refused to review that decision.

This legal matter is the most recent in a series of cases related to executive authority to appoint preferred leaders at government agencies.

The High Court has generally permitted such dismissals, even as court disputes proceed.

However, this particular matter concerns an office inside the Library of Congress. Perlmutter serves as the copyright registrar and also counsels Congress on intellectual property matters.

The solicitor general, D John Sauer, argued in the filing that, despite ties to the legislative branch, the register “exercises executive authority” in overseeing intellectual property rights.

Perlmutter alleges she was fired in May because the former president disagreed with recommendations she gave to Congress in a report concerning artificial intelligence.

She reportedly got an message from the administration notifying her that her position was “ended starting immediately,” as stated by her staff.

A divided appeals court group decided that Perlmutter could keep her position while the legal dispute moves forward.

“The administration's alleged blatant meddling with the duties of a congressional official, as she performs statutorily approved duties to advise Congress, appears to be a violation of the separation of powers,” wrote Justice Florence Pan for the appeals court.

Judge J Michelle Childs joined the opinion. Both justices were nominated to the appellate court by Democrat President Joe Biden.

In dissent, Justice Justin Walker, a Trump appointee, argued that Perlmutter “uses executive power in a variety of manners.”

Perlmutter's lawyers have argued that she is a renowned intellectual property specialist. She has served as copyright director since ex- head librarian Carla Hayden selected her to the role in October 2020.

The former president appointed deputy attorney general Todd Blanche to replace Hayden at the national library. The administration had fired Hayden following complaints from conservatives that she was advancing a “progressive” agenda.
